How do i get out of an out of state photo radar speeding ticket?

I recieved a ticket that says i was speeding thru a photo radar in albuquerque, nm its my make and model and plate number but I am 6'3" and it apears someone short is driving the car the persons head is barely higher than the headrest.(there is no front photo of driver im looking from a back view). I know i could beat this no problem if i wanted to fly to albuquerque from sacramento but this would end up costing me just as much if not more. anyone else been thru this know what to do?
 
lol @ not you driving give it up dude.... you were driving and you got caught so man up and pay the ticket and stop speeding
 
OK, you have effectively admitted is WAS your car. Even if someone copied/stole your plate, the odds of it showing up on the same model car are essentially ZERO.
Unless you can turn in the actual driver, or swear the car had been stolen, you are liable for the ticket. Proving you were NOT the driver won't help unless you can show WHO the actual driver was.

Flowers, The type of statement you describe would not even be admissible in most states. It would not disprove the camera in ANY.
 
Clearly you're not telling us everything. We're you in Albequerque?

I'm sure it's you and you're using the "the person is not me, my car must have been stolen and then later returned to me" excuse.

What it boils down to is, it's your car, even if you actually know the person driving your car, if they will not accept the ticket, you get charged - you literally have no case. If you can get someone else to claim it was them and they'll take the ticket, that's the only way it won't be charged to you.

But it was you. You know it, I know it, everyone reading this question knows it.
 
If you work you can have boss give you notarized statement that you were at work at that time. Or in school from a teacher. But it has to be notarized to be recognized by the court. Email Alb. NM's DMV and ask what they require.
Have you checked to be sure one of your plates was not stolen and replaced with another?
 
Hiring an attorney to represent you would be the only other way for you to not have to fly out there for your court date. This too could end up costing you a significant amount of money.

Can you without a doubt prove that person driving the vehicle is not you? If you can't you're going to be held liable for the ticket. It is your responsibility to prove it's not you, and you may have to provide the name of the person it is so they can be issued the ticket.
