How do I get activate a Verizon phone without getting a new contract?

My contract with Verizon Wireless expired in December of last year. I still have and am using the same Chocolate II that I got when the plan was first activated two years ago. I think that it is time for a new one.

Now, if I buy a phone off of eBay, would I be allowed to activate it without getting a new contract?

Also, how would I go about activating it? Is there any special information that I need?

One more question, if I choose to get a smart phone or blackberry, would activating and using it be the same if I just chose a normal cell phone?
