I think that people new to the country or people who don't have pristine English can tend to fall prey to employers who would take advantage of them not knowing their rights in the work place. I think there needs to be awareness of that so they can protect themselves.
Apart from that, not sure. Maybe EEO can protect from discrimination, eg people with accents that have fluent English and enough English to get the job done, but someone might get a job over them because they were born here and have an Aussie accent? Dunno.
