Home office in court against Human Rights?

A foriegn lady is going to court to stay in the UK.. She got divorced by her British born Father and has Baby by the Baby is not registered British by the British.....The British Father cancelled her visa and sponsor so thus did not renew it, plus they got divorced during the 2 year spouse visa...Now she is going to take the British Home Office to court so she can stay here..She made false allegations of domestic abuse...The father divorced her because she used him to stay in the UK. What are the chances of her being deported? the Father does not want to do anything to do with the Child as he knows she will use it as a weapon against him..So does the Baby go with the Mother?...Again they got divorced during the 2 year spouse visa. She wants to stay here in the UK just because her child was born here, but surely you don't automatically get rights to British Citizenship just because your child is born here? otherwise every Woman will do that. There is no domestic abuse even though she made it up, as there are no police reports or anything..So the courts have to rule in the Home-Office favor? if Father wants custody of child then that will give her more chance to stay in the UK as she is the Mother and can have contact with the child? so if Father says she doesn't want anything to do with the child it works in the favor of the Home-Office doesn't it?.
