Hit by uninsured driver...what are my chances of getting my car repair paid for.?

I stopped at a pedestrian crossing to let a lady and her baby cross when a car hit me from behind. I am guessing she was on a cell phone as there was no screech of brakes or tire marks. Called the police who took a report. The lady that hit me asked me not to contact her insurance company but to get a quote for the damage and she would pay for it. Maintained she could not afford the increased high insurance premium. Turns out she does not own the car and is not insured. Of course she does not have money to pay me either. What are more options here. Any sincere honest help would be greatly appreciated.

Also she has lied on the police report. As she gave the office a policy number that does not exist and a company that she is not insured with. We are in North carolina by the way. Thanks.

Sue the heII out of her. Small claims court. She may be broke but make her life harder, she sounds like she deserves it.
 
If you have collision coverage on your insurance then file the claim through your insurance agency. You'll have to pay your deductible. I know it's not fair but there's no way you can get around it. Sorry about your car
 
You need to file a claim with your own insurer asap! They will repair the car (minus your deductible) and hound the other driver to the depths of hell until they recover the costs of the claim, which includes refunding your deductible.

Claim it on your insurance and your insurance may decide to go after her and her fraudulent info...
 
You will simply have to use your own insurance. Have you called them to notify them of the accident?> Why not? that is what you have insurance for...Use it !
