Help my Kyocera Laylo M1400 Phone wont turn on?

Kyocera Laylo M1400 Phone wont turn on, the first incident was last night when i was watching a movie and texting my phone turned off on me, and i just thought it was hot so i left it alone and about an hour later it started working. Then it happened again when i was texting so i put it in the fridge to cool it off for 3 min. and it started working again. Then today at the barbershop it turned off in my pocket and it did it again. Now it is not working and it won't charge and wont turn on......help plz
I bought my phone on 12/26/09
 
It could be that your battery is defective.If you can go to your local service provider store. Ask to have a new battery in your phone and see if it acts normal.If it does then great you just need a new battery.
