it's now secret that the oscars largest tv audience was when Titantic was up for best picture.... why - because it was a big movie that a lot of people saw. Every year since then, the oscars have steadily decreased in viewership. because there hasn't been any big blockbuster nominations to get people excited about.

this year, from a purely business standpoint the oscars need to nominate batman the dark knight for best picture and heath ledger for best actor. the amount of people who would tune in to see if this movie won would be incredible.

you don't give best picture to batman, but you do give best actor to heath. and bam, you make money and restore the oscar brand.

There's actually a huge movement to give him a posthumous Oscar, and he would be the second person to get one. The first in over 30 years.

I think he's screwed either way

He doesn't win the Oscar: That's a major snub and an insult, his performance was Oscar worthy.

He does win the Oscar: It'll be controversial, and the award will seem like a pity award to many leading to an endless dispute over whether or not he should've gotten it.

Personally, I'd like to see him get one (it'd probably be for Best Supporting).

okay... so we seem to agree that he should get it for best supporting. that's fine.... and while i think he deserves an oscar for his performance, i also think it would be worth big dollars to the academy to nominate him for a pure, cold, unblinking business perspective. i mean, even if they think his performance wasn't oscar worthy - i still think they should nominate him for the cash money !

Maybe just give him one of those honorary awards so you can avoid this dilemma.

No risk of it being a pity award over someone else. No risk of people saying it was a disgrace that he lost.
