I'm in California.Hello, I am taking my landlord to court to get my security deposit returned. Has anyone won a case like this? And how did you do it?
My landlord took half of my deposit and I believe he did it improperly. First, the unit was a co-tenancy and he did not inform me at all of what he charged my roommate. Also, when I moved in the apartment had already been occupied for two years and the law states that I cannot be charged for cumulative wear and tear. I lived there for another year and a few months. I asked the tenant who lived there before me and she stated that there were no repairs done in the two years she lived there, and there were no cleaning or repairs done to prepare for my move in. Yet he still charged me for cleaning and repair of the apartment. Also he didn't return my deposit within 21 days. He returned it after a month when I told him that I didn't recieve it. When I told him the law states that after 21 days the deposit should be the full amount he said I'd have to sue him to get it. And that he'd be countersuing me.
I'm not sure of how the courts work and I just would like to know any tips people have so that I'm not at a disadvantage.
