flashed xbox 360 banned?

I have a question i got banned but i dont know why i have a flashed 360 and the newest game that i played was codmwf2 but offline so this is how it went down i put in midnight club la(it is a legal game i bought at gamestop long time ago) i played it for about an hour and i took it out and put in burned version of cod4 (ive been playing that game for over 1 month no problem) so i try to sign into xbl to play multiplayer and it says console banned i need answers to why i got banned plz help!!!!!!
 
when you play any game it is logged to your profile therefore they can see if you have played any game before release all they have to do is look at your profile next time you log on
