I was recently fired in the at-will contract state of Missouri. I was fired after my supervisor returned from a week and a half vacation. According to the employee handbook, my supervisor did not have to give me a performance update or let me know that I would be fired from the company because I was within 3 months from my hire date. My biggest issue however is that the morning I was fired, a different co worker (co worker not on my team) loudly and bluntly asked "Had I been fired yet?" while I was walking into the office. I did not think much about it except this was the same day I was actually fired.
In my termination log, my supervisor wrote that "she and others" felt that I could not be independent at my job. She also wrote that I had "initiated several phone calls about questions I had already been coached about" but I never called her once (I did however call some of my co workers). I also found out from a different source that they were specifically asked about my performance when my manager returned from vacation.
Is there any labor law against being able to discuss performance about a co worker with other co workers? Further, the fact that the co worker "guessed" that I would be fired is already fishy and makes me wonder if word had been passed around. If this is a case, what law should I be looking at because it does not fall under any of the discriminations, or does it? My employee handbook does say however management should be the only people making decisions about my performance (not co workers).
