Films where the bad guys win.

The Long Good Friday and Get Carter spring to mind but I don't think the "good" guys are any better than the "bad" guys in those two films.

The Long Good Friday ended OK for the good guys (well bullet wounRAB notwithstanding)
 
It's always difficult to define what consitutes a bad guy and even harder is defining what is 'winning'.
For example:

Goodfellas - whilst the 'gang' get shopped, Henry relaxes in freedom (although to him it resembles imprisonment)

Fight Club - Is Ed Norton a bad guy or is it really Tyler Durden?

Deliverance - Who are the real bad guys (ahhhhhhhh!)

etc, etc......
 
Phone Booth.

Bad guy doesnt win especially, but he does walk away very slowly.

Also, there was a 70's film called "Two Minute Warning" in which bad guy kills lots of people in an american football stadium with a snipers rifle, and again walks away very slowly.

Also, finally, it's not really fair to say Empire Strikes Back when it's the middle of a trilogy and the whole point of the 2nd act is to put the good guys in a tough spot.

For that matter, what about Godfather 2? (Whoops, sorry Fredo, the boat must have gone over a pothole and my gun just kinda went off).
 
I would say to some respects The Sum Of All Fears, the bad guys get away by setting off a Nuke at the Superbowl, but in the end an all out war is avoided.

Terminator 3 comes to mind, Skynet goes live and the ICBMs fly..
 
Haha don't worry, its not a film about good and bad. The good guys (paying audience) lose when the bad guys (Film makers) make the worst teen comedy film ever.
 
T3 and Sum of All Fears would have to be applauded for the fact they are mostly typical Hollywood blockbusters with a very dark element to the ending. Although with SoAF it's not at the end, but the very idea of the bomb actually going off is something not seen often in Hollywood. You could also add Star Trek 2 and 24 (not a movie but I don't care I'm adding it anyway so there).
