file a civil court case vs the dealership?

brought a car from the small dealership and they can't finance my car so they ask me to bring the car back and get my full down payment back when i bring it back to the dealership they say that i say that i burn the clutch which they goin to deducting the money from my down payment so now i file a civil claim against them so what should i do next and would i win the case
 
DID you burn out the clutch? If you did not have ownership of the car, but were using it, you have a duty to look after it. Mistreatment of the vehicle is in fact your responsibility, so i can't see what YOU be suing for.
