I put a fence up on what I thought was the boundary line with our neighbor 3 months ago. I was going to put the fence on our property 2 feet but our neighbor cam outside while we were constructing and told us where he wanted us to put it. Today he had surveyors surveying his property and he thinks the fence is 6 inches on his property. I told him I would move the fence off of his property but he said no that it would not be moved until after he takes us to court. My question is why would he take us to court for a judge to tell us to move the fence when I am willing to move the fence now. More info we live in a rural community with no city ordinances. It seems like if we moved the fence he should be satisfied. I told him I was sorry we mistakenly encroached on his property and I was happy to move the fence over onto my side. But he was very rude and told me I couldn't do anything until he took us to court.
