Denise, You will not go to jail for not paying the pdls. Sending payments with be a good faith gesture. Close your account and reopen a new one, but do not give the pdls your new account number. Pay the amount you borrowed.

So they cant put you in jail for not payin a payday loan right!!! can they say it was a bad check and use that against me? so they can and probably will take me to court? What should I do I have about 12 payday loans and I cant pay them back right now but don't get me wrong I do intend to pay them back when I can.

They can't say it was a bad check,unless it is a bad check,for that you can get in trouble.I noticed you haven't signed up for the site,if you do,and sign up for the free credit consultation,someone will contact you about consolidation and other solutions that will help. They will figure out your debt to income ratio and find a plan for you,You will see by the other threads,that there are many going through the pay day loan he** that you are,and what they have done to climb out-good luck ...Karen

These people are amazing. They refuse to provide Validation of Debt and called my husband "player" and "brother" and pulled my credit report for a supposed debt of my husband. Claimed that we owned "Blue Bell Creameries" where my husband works and that he would garnish any further earning made by Blue bell Creameries. Blue Bell has been in business for 99 years, and my husband drives for them. CRAZY! So I did a little research on the company and found out that the president of the company is RYON ALAN GAMBILL. Well, he has several companies. I called a number from another company he owns. He answered the phone and told me that he "was too important to talk to me" and "he doesn't talk to debtors" and that if his company was cllin me that "I wouldn't get anywhere unless I paid". My husband doesn't owe this debt, even though we have bad credit, this is not valid. They assume that since our credit is screwed anyway, that we won't dispute something that isn't right. Well, they are
surely wrong about that. The original debt is for $115, they threatened to garnish him at 45% of his GROSS wages for $2047.19! Oh My Goodness! These people are amazing!

Hey KC..

Don't worry about the garnishment... First off, they can only garnish 25% of your disposable earnings..That's everything after taxes and voluntary deductions.

What payday loan company is this? If it's an online lender you don't have much to worry about anyway..If they aren't abiding by your state's loan laws Then they're going to have a pretty tough time finding a judge who will give them a judgement. It's incredible what these people will tell you.

Pretty interesting that Mr. Gambill was "too important" to talk to you, but he answered his own phone. I guess business is slow.

All these recent posts sound like scams.

If you have ever had a payday loan then unfortunatly you also gave out all of your personal information. Information that can be bought and sold leaving you vulnerable to these scams.

I would imagine that they are just trying to get a quick buck out of you. I would not pay and would inform them that what they are doing is illegal and that you will be reporting them to the authorities. And don't just say it - actually do it. Try to get their last names and any direct contact numbers. They are the crimminals not you so treat them as such.

Check fraud is only for currently dated "live" checks. Its not for post-dated checks or checks used to secure loans. If a PDL takes your check to scure a loan then its their loss if you choose not to pay.

Ok I live in Houston Texas and I have about 13 payday loans. At first I only had about 2 and I was able to pay it off until things started getting real bad 2 were I couldn't pay it back and I had to keep getting different loans to help out my situation. Now it's up to 13 and I don't know what to do. they call and say that I have until a certain time to pay back. Some1 jus called today and told me that it looks like I never intended to pay them back in the fist place so there going to take me to court for fraud I CANT GO TO JAIL I JUST HAD MY BABY PLEASE SOME1 TELL ME WHAT TO DO!!!!!!!!!

You need to call and try to make arrangements with the store front lenders as soon as possible. Store front lenders can take you to court and get a garnishment.

Hi, my name is Ruby the job I worked on went out of business and I was out of work. My husband was trying to help me pay on a credit card account but he could only pay what he could but some how he managed to get the account current. A collection agency has been calling for the last two months and I told them the account is not behind it is current but they want listen. I contacted the creditor and they told me to keep making my payment to the store as I was doing before. They also told me that I do not have to talk to the collection agency. But the collection agency will not let up with their threaths. Is their any thing leagal I can do? The creditor is still accepting my payments and each time I call the customer service they tell that my account is current.

Nell, send a cease and desist letter to the collection agency's mailing address. This letter will legally force them to stop contacting you. If you want, give them option to contact you only through mail and not by phone. It still works if you don't specify anything. Since your account has not reached the collections yet, I wonder why they are placing calls to you. See a template in the link below and send it through certified mail with return receipt requested.

Also, go through the FDCPA for knowing about your legal rights when contacted by a debt collector. I believe the collector is involving in one of their shady practices. If your creditor has not sent your information to them, why are they calling you? Ask them if they can stop the collector from calling you further.

I fell into the PDL trap recently and took out a total of four totaling about $600. Not too bad, but it could be a lot worse.

There is one locally owned PDL store that is extremely stingent on when they want their loans back. I missed the due date because I couldn't pay it back, but they are not threatening lawsuit on me if I don't pay the minimum by next Friday. The loan was for $400.

Folks, DON'T do payday loans. They help for a while, but in the end they WILL come back to bite you in the ass and while you can indirectly "get away" with not paying them, just pay them if at all possible.

If you absolutely need to take out a PDL, don't do any off the internet. Go to the stores as they are much easier to deal with (in person is better won't you say?) and you're not taking a chance that Mohammed-Abdul-Crakasowski will be on your back saying you owe $3,000 off a $200 loan. Those online ones may have really pretty flashing banners saying "get cash now, no credit check". Basically that means "get some help now so that you can get screwed later!"

My name is JB and I have a problem. About three years ago I ran into some problems with my finances, my job went out and I started to get behind with some of my bills. I contacted mt creditors and try to explain what was happening with me. Some of them worked with me and I was able to get my accounts back current. However, I still have one that I only got caught up last month. The problem is I was paying on the account but I was not paying the full amount of the payment. The account was turned over to a collection agency a day after I paid a payment and got the account caught up. I tried to explained to the collection company that I had brought my account current when I paid a hundred dollars on the account, but they want listen to me and is demaning that I pay the total amount. I have talking with my creditor and they said that the account is current and to just keep making my payments as promised. I called the collection agency back after they have been calling my home day
and night at all times of night. I told them that I had gotten in touch with my creditor and that my account was no longer behind.But they say I must pay up or they will take actions against me to collect the debt. If I have contacted my creditor and they have not charge off my account or send it to the credit buera. Why want the collection people leave me along after all I do not owe them anything? I understand that some people do not want to pay their debts but that's not me I want to pay what I owe. I just had a run of bad luck.
I have been thinking about filing bankrupt but I do not want to do that now since things are looking better. What can I do to stop the collection people from hounding me?

JB send the collection agency a cease & desist letter and insist with the original creditor that they pull the account back from the collection agency. You didn't say if this was a credit card or what but if the payment is current there is no reason for the original creditor to object to getting it out of collection.
