between them and the band they are "ripping off", or if there is one, it is superficial at best?
A good example for me is FARMAKON, a Prog/Death band from Finland, that is often accused of being an OPETH Rip-Off.
Why? because they use a) Progressive song structures, b) intersperse harsh vocals with clean melodic ones and c) alternate between Extreme Metal and Melodic Metal.
By this reasoning, of course, pretty much every band that that blends Prog and Extreme Metal is an Opeth clone.
From a more balanced analyses... yes, the harsh vocals are not of a dissimilar style to Mikael's. Not a shock, as many people sound similar, and truth to tell, their ain't THAT much diversity in harsh vox. His clean vocals? Sound nothing like Mike's. In fact they are kind of off putting at first, but I find their kinda raw nature grows on me and gives them their own sound.
As for the music, Opeth on their "Heavy" side is much more akin to Goth/Doom like Draconian than the Death Metal they are often labeled, and their acoustic interludes tend more towards blues and classical, with some folk hints (and other, minor) influences. Farmakon, by contrast is clearly Thrash based Death Metal, with heavy infusions of Jazz and Funk to their bluesier breakdowns.
So are they similar? Sure in the way that almost all movies are similar, in that the basic plot development follows a pretty standard series of acts and climaxes. But it is the DETAILS that make different movies and different bands worth the time. (Also, I ain't saying they are as good as Opeth, musically... Mikael is a fabulously gifted musician (even if his clean vox are WAY overrated), but that I do find in all, these guys to be more entertaining, when Opeth starts to drag a bit for me.

Now maybe if Opeth and Mike Patton got together and had an insane bastard love child, I could see it being like Farmakon, fut to call them an Opeth clone, IMO does both them AND Opeth a major disservice.
