I'm doing a paper on the 1981 supreme court case 'Rostker v. Goldberg.' The argument is that women should be included in military drafts because having them excluded violates the Due Process Clause of the 5th amendment. I'm having problems establishing what exactly that has to do with it. It seems to me that ANY military draft invades the rights that are set forth by that clause, and I don't see how having women included as well as men in draft registration is any more constitutional. Help?
