Does this sound like "Samsung" have lost my handset?

Hey,
I emailed samsung when i began having trouble with my phone, they informed me to send the handset to them, and they would fix it.
Its been about a month now, and i have been emailing them asking what is going on with the repair. I got a phonecall from samsung themselves today telling me because its been longer than 28 days to repair it, they will exchange my hanset, but they dont have my model in stock. So they have offered me a different phone, (which happens to be a better model). I said to them at first, could they just ask the warehouse for it back, and i will get it fixed somewhere else, but they refused. So i have settled for the newer phone...
It sounds to me like they have lost it?!
 
Threaten to take them to the small claims court,They should offer you a cash payment so that you may buy a phone of your choice.Submit the receipt if you have it(Copy Only) as you would need the original one and proof of posting the phone,ie a copy of the email to say that they had received your phone for repair.Good luck!
 
I agree. At the end of the day that phone is your property. You have paid for it either as Prepay or on Contract legally it is your. If they loose it then they would have to replace it....which is what has happened here. However even though they are giving you a better alternative, if you refused they really have no legal right as to why you cant have your phone back...unless like you say...they have lost it!
