Does my Dad have any right to ask for a court date?

DSS (department of social services) got involved in my house. My Dad walked out, moved across the street, and we still saw him at the time. Me and my sister were living with my mom when DSS got involved and we told them things and it was totally twisted around to make my dad look like a pedophile. He was supposingly found "guilty" of what happened and we aren't allowed to see him anymore. The stuff he is guilty of is "touching me" when what I said was he used to get drunk and make me sit on his lap and would sometimes put his hand on my leg. That's it and they twisted it around to make him sound like he was touching my vagina area. I still keep in contact with him via email and he said that he asked for a court date to resolve all this and they never called him back. He says as far as he's concerned, he can still legally see me because he was never called back. My mom says they won't call him back because he's a "pedophile" who can't even be in the same car with me. I don't know who to believe. Does he or does he not have right to a court date and can he still see me?
I'm 16 by the way. I'm sorry I don't know as much as I should about this kind of stuff.
And by the way, "across the street" was meant as a phrase. He doesn't live literally across the street, he lives about 1 or 2 miles away from my street in an apartment building.
