Do you think this is a bad precedent?

Alaina Giordano of Durham, NC was diagnosed with stage 4 breast cancer three and a half years ago now stable and not progressing, is fighting for custody of her children ages 5 and 11. The judge in the case has ruled the children’s father should get primary custody and he now lives in Chicago.
Judge Nancy Gordon ruled that in part because "the course of her disease is unknown" and "children who have a parent with cancer need more contact with the non-ill parent." Giordano does not have a full-time job and cannot support the children, the father should get primary custody. If Giordano wants to be near her children, the judge says she should move to Chicago.
Mind you she had quit her job and moved to Durham years early for her husband’s job.
I find this ironic coming from the same state who embraced Elizabeth Edwards.
