Obviously it fit's over the ear so the user can hear conversations but in the descriptions i've read it must be docked in the charger to be used as a microphone ?

Surely you don't have to dock it to ask a question and then put it behind your ear to hear the answer ?

Would i be better off buying my son a sony headset with a mouth and ear piece ?

Advice would be gratefully accepted .

I would not recommend it because I got one and it hurts my hear and it's just plane comfortable to wear. The ps3 works with any blue-tooth, so go get a nice one that you like, you'll be much better off

You only need to dock it to charge it. To talk you just wear it.

In my experience the Sony headset works better than standard bluetooth headsets, it has a noise cancelling microphone built in that reduces background noise (like the music and sound effects from games) being transmitted.
It also integrates with XMB better (having pop ups that tell you when you mute etc.)

Unfortunately isn't the most comfortable headset, and I find myself frequently swapping ears during online play.

The problem with a full headset is that it will muffle the sound effects from the game, so that you will miss directional sounds (like footsteps behind you) which in some games like COD4 can prove very detrimental to your online gaming.
