I live in Ohio, which is smoke-free, meaning you can't smoke in public places, restaurants, bars, etc.. Many companies have adopted a zero tolerance policy on tobacco as well. I understand the right to ban tobacco use on their property, but some deny employment to those who admit tobacco use and have even fired people when they find them non-compliant with the policy. I'm assuming this is implemented to keep insurance premiums down and employees are subject to nicotine testing as well as drug testing. Is consuming a legal substance on your own time, even if it violates a company policy, worthy of termination?
