Dispute over a rental deposit?

since real estate is a ON paper environment........without a written agreement the landlord has no
legal rights on the deposit.
 
My husband and I paid $300 to hold a room in a house. We did not sign any rental agreement or any paper saying that we forfeit the deposit if we do not rent the room. The lady we are renting from now tells me that she assumed we forfeited the deposit when she told us the day we paid it, that she would refund it if anything changed in our situation. All she signed was a paper saying we paid said deposit.

We paid on Saturday and I notified her last night. She did not get back to me until today. If she does not refund our deposit can we take her to court over it? Or what should we do? We cannot afford to lose that amount of money and we found a place that was much cheaper for us to rent.
We did not sign any agreements as to even renting the place and she made a verbal agreement that she would refund us in cash if it did not work for us. Which it does not.

We NEVER signed any rental agreements and we have by law 72 hours(according to the apartment we are applying for) in which to notify anyway that we are not renting to get a FULL refund. It was less than 72 hours so therefore we get a refund in any case anyway.
