Disclaimer a valid defense, when depicting images of fast food products

that in no way...? ...resemble the actual food product?
Can you imagine if a car company showed a photo or video of a shiney new model car, only to have you find that the actual car was sloppily assembled, and barely resembled the car depicted in the ad? I can't think of a better example where there's a bigger disparity between the advertised product and the actual product. Have you ever gotten a Subway sandwich that looked anything like the one on TV, or on the menu board? What about a Big Mac? I can't imagine that in today's world, a disclaimer stating something like: "Product image for illustration purposes only. Actual product may vary" can absolve the manufacturer of responsibility. I for one am tired of ordering a beautiful looking sandwich, only to find that I walk away from the register with a squashed, poorly assembled sandwich that isn't at all as advertised. Isn't it about time legal action was taken against the prime offenders?
