Disciplined for using sick time. Is that legal?

Four months ago the Diagnostic Lab that I work for amended the sick time policy to state that employees who take more than 1 unscheduled absence within a 60 day period will get disciplinary action. Unscheduled absences are absences where your supervisor has not approved and has not been informed of the absence 48 hours before it occurs. This includes sick time, snow storm related absences etc. They also make you use vacation time if you run out of sick time. I got sick in December. Then in January, I and could not go to work because of a heavy snow storm. I had the sick time to take, but I still got disciplined. Everyone is scared to get disciplined so a lot of people show up to work sick. Contagious diseases spread rapidly. Is what the company doing legal? Mind you, the executives ARE NOT SUBJECT to this policy.
