I have to provide a brief anwer to the question: “When should records comply with the data protection act?” and have come up with the following answer. Please can anyone tell me if my answer is accurate?
All records, whether on computer or in paper format must comply with the data protection act. If a ‘subject access request’ is applied for, the ‘requestee’ is legally obliged to show the ‘requestor’ their records within forty days. The only exception to this rule are records - usually in paper format - that are not in a filing system and highly structured.
