In most areas you would be allowed to cut the roots and any branches that hang over your property. However, you will not be allowed to put the branches on the neighbor's property.

One thing I would do is send her a certified letter advising her of this dangerous tree and asking her to take care of the problem. This would protect you if the tree did damage to your house or building she would be liable for the damage if you prove via the letter that she was aware of the danger from the tree.

Our neighbors tree was struck by lightening. My husband had just grabbed our son out of bed as it sounded like a tornado. The tree damaged our house. Our neighbor hired worlers to cut and remove debris, and our insurance fixed our home. I nad been asking them to remove then overhanging branches. We had no extra money, and my x, a lawyer, never cared about a thing but the child. I guess you have to talk to your village council. I don't know your local laws on property matters. usuallt neighbors work together. My neighbor ignored me.
