Copyright Infringement of photos on a website- Is a cease and desist order

required or a courtesy? If someone is using my pictures on their website, do I have to send a cease and desist letter, or can you go straight to filing suit?

Sending a cease and desist letter is going to cost money to have a lawyer send it, why not skip that step and go straight to suit? Not worried if it reduces damages that can be collected, as long as it will be a legal claim.
I do have the original image, full size. Everyone else has a reduced size image. Not too hard to prove it's my image.
Adding credit is not an option, it's a competitor, working in the same market.
I usually do guerilla tactics when someone uses my photos. Bad reviews, calls to state licensing boards, e-mails to craigslist, Google DMCA is the next one to try. One time a lady asked about a company outside of my area. I saw one of my photos on their website, needless to say, they didn't get the job.

Sort of what I thought, they steal, and it will cost me lots to do something about it.
