clutch gone whilst car getting repaired who's responsible to fix it? ?

my car was in an accident about three weeks ago damaging the front drivers side. the repairers picked up the car in perfect working order (apart from damage after crash) whilst they have had the car the said it has been working fine although today they rang to say that there was a problem with the car the clutch had gone today. they are saying that it is just one of those things although i thought that whilst the car was with them it is solely there responsibility and the insurance company have said that they are not prepared to pay for it because it is not related to crash. So not only have i had to pay the excess for car up front of £600 i now have a car that is not drivable.
HELP i need some advice asap thanks
 
depends on problem clutch pads plates , or hydrolic cylinders master and slave no response to engaging or peddle has noplay or falls to floor re ask or wont pull on release and gettupgo,BURNT some times motor mount damage fails to support causes similar
 
When a clutch wears out it just happens. They were just unlucky to have it when it happened. You can't really expect them to pay for something that you wore out and they had it at the time it went out.
 
If the front drivers side was damaged then its possable that the clutch mecanism was damaged at the same time may not have been noticeable untill other repaires completed
 
What they are saying is that the clutch has been going, and was on the edge for some time. Clutches wear out, they don't just break.
 
What the shop is not saying is that they somehow messed up the clutch and want YOU to pay for it. Raise a stink with them....
 
IT should be on them if the car was working fine before they got it. Sue their @SS
 
I worked for a shop for 20 years and to be honest sometime sh*t happens. If we lived in a perfect world then no this could not happen but we don't and it does. try and cut a deal with them most shops will try to keep you happy and maybe give you some labour time off or even if your lucky some off the parts. If the car was broken into or further damage at the shop yes it would be covered but the clutch is a maintenance item. This will be your responsibility as the shop could not be responsible for the maintenance of your car. Clutches do go out and it maybe just bad timing of it all. Other thing is the shop can possibly help you if they can find something related to the clutch system that was damaged in the crash. If not then your out of luck as it will be up to you to prove the crash took out the clutch
