Alright, so last saturday I went out with some friends from out of town and one from town. We went to a bar on campus and had a drink or two. None of us were drunk as far as I know. Well our designated driver for the night was going to take us back to his house to hang out for the rest of the night after we finished a game of pool at the bar. On our way back down the main street of campus, one of my friends was kind of joking around and saying some funny things out of the window (nothing insulting or mean) just for fun. Well we stopped near a red light, and one ridiculously drunk guy with his drunk gf I guess got really mad or wanted to start trouble, so he walked up to the car and punched the car, then punched my friend in the face through his window. Blood splattered all over the seats in the car, so my friend driving drove the car down the next perpendicular street and parked, and we all got out to confront the guy and ask why he did that and what his problem was, and what his name was so we could report him to the police.
The guy was extremely drunk and refused to cooperate, and kept yelling insults at us and trying to get us to fight him. We were very calm as far as I remember trying to resolve the situation without having to call the police at first. He continued to act belligerent and then punched my open window friend again, and then my friend was forced to defend himself. We kept yelling at the guy to stop before someone got hurt, then he proceeded to move to other friends and attack them, and eventually he moved to attack me at some point, in which case I had no other choice but to defend myself. I only fought back enough to keep him at bay and away from me, and attempted to grab my phone out of my pocket several times to call the police, but was continually attacked and aggressively approached by him. Eventually I knocked him down as a result of trying to get him off me, after he broke my nose and gave me several open wounds on my hand and body. My friend who was driving had disappeared because he had to get the car back and he was looking for us, but somehow we all got split up, so it was me and two other friends walking away from the area and looking for our friend and possibly a police car to assist us. We had walked maybe a block away and ended up behind a building somewhere, when a police car approached us, and officers stepped out and apprehended us. We asked why we were being arrested but they would not answer.
We were sent to jail and bonded out shortly after our initial court hearing the next morning, and have gone to arraignment, but are now facing two felony counts of aggravated battery. Our driving friend is not being charged with anything, nor was he apprehended. We are now using him as a witness to testify on our behalf, but my question is, do we have a case we can present in court to prove out innocence? The guy and his girlfriend fudged their stories to the police, and we know this because one charge is for him, and one for her. During the whole time, she was being aggressive too, but she did not attack us, and we did not touch her. In fact, we pretty much ignored her the whole time, she was not our concern. We have collected some evidence, which I will not reveal on here in case someone is reading this, but I was wondering if we have any chance at having the charges dropped? None of my friends have priors but I have two very minor misdemeanors on my record, which were from several years ago, in which case I had successfully fulfilled the court requirements for.
Can I get out of this? Do I stand a chance? I really don't want my life to be ruined, I have so much going for me, about to graduate, good finances, a potential job in the near future, everything is going perfect in my life except for this. I did what I thought was right and knew was legal. Please let me know what you think!
