Car Repo- Do I really have to Refi?

my friend has a car loan through a local/small credit company..

one June 21 her car was "repo'd" right off my driveway. I saw a guy just get in the car and drive off..(is that legal??) for a sec we thought it was stolen..

They didn't leave any information behind.. It takes us the next 3 days to finally be connected to a rep. from the office-- we called and she was asked to come in to pick up her belongings.. Half of her things we're missing + a few envelopes she had in the glove box (personal mail) was ripped open. We asked for the other belongings and they acted as if it was never in the car.. We asked what we can do to get the car back, they said they would let us know. -- it takes them about another 5 days to get back to her-- she's asked to pay the loan up to date and she can can get the car back..

We go in to pay what she owes ($1200) and they tell her she can't get her back-- that it's going to auction-- that there's nothing she can do about it..

Now after going back on what they said, they've offer to give her the car back if she refinances the loan with another name..

(The loan is under her name, and her ex-bf co-signed for her.) if she doesn't do so.. her car will be auctioned on July 20

My question:

1) the way they repo'd the car, is that legal?
2) she is able to pay for the car up to date, why does she have to re-fi?
3) she added some mods to the car (i.e springs, spoiler) she asked if she can have those back (since she did not buy the car that way), they said no, can she do anything about that?
4) the way they're going about this has been so unprofessional, can she do anything to fight back?
5) they said if she refinances, she's going to owe additional fees such as towing fees (in the beginning, they told her she didn't have to pay anything else except her loan since her car wasn't really towed) if she refinances, can't they just zero out those additional fees and just make her pay what she owes?

I know nothing about car repossesion, but i think it's weird they just don't give her the car back if she pays what she owes, what with all the extra baggage..

1) yes..
2) because she was in default enough to be re-po'd, and her credit is longer good enough

3)No she cant because they become part of the car, she shouldnt have modified until the car was PAID FOR..

4) Unless she can prove some law was broken, no..

5) she has to pay those fees because they were incurred because she defaulted on her loan...It isnt fair to make the finance company eat HER mistakes...
