Well if you only have front airbags, no side airbags or anything, they had no reason to go off. You didn't hit the tree head-on, and it probably wasn't big enough to set it off anyway. You said yourself you hit the tree with passenger side fender, not direct head on. You would have tripped one sensor at most. As to the bumper COVER being torn off(trust me it didn't tear the bumper off, that is still a metal bar tucked further in the car's body, the cover is that plastic cover that looks pretty and people see), that thing is pretty flimsy in general. You likely just broke it on the right places on the side and that broke it off.

I agree with fire4511; unless the bumper itself made impact (whether it be at a direct hit or an angle) the air bags would not have deployed.

There is a specific order in which things have to happen in order for the SRS to deploy; 1) sudden deceleration;2) frontal or rearward impact; etc.

Airbags should not deploy in all accidents that occur at 40 mph, especially accidents in which a vehicle flips upside down. An airbag that did deploy in all accidents that occur at 40 mph, especially accidents in which a vehicle flips upside down, would be extremely dangerous and possibly illegal. Airbags must be designed to deploy only in those accidents in which they would protect the occupants, and not in those accidents in which they would increase the danger to the occupants.

2002 Ford Mustang V6 Coupe

I was recently involved in an accident.
I was run off the road by a teenager who was driving a vehicle that wasn't registered to him, and who didn't have a driver's license. My car went off the highway and slid into a ditch (maintaiing a speed of about 35-40mph) where it crashed into a tree (passenger side front fender) and flipped over, landing on the roof.

I blacked out and came around after the car was resting upside down so I dont know how many times I flipped. But the car was completely destroyed. Almost unrecognizeable. The roof was crushed down below the headrest on the drivers side, and the front bumper was torn clean off, and was lying in the grass 50ft away from the car.

My airbags never deployed!
Is anyone aware of a reason why a car that hits a tree going 40mph and then flips, doesn't have the airbags go off?

Do I have legal grounds to take action against Ford? And if so, what should I expect?

Thank you so much in advance for your help!
