Car crash and not enough insurance?

My dad was hit by a drunk driver in a car crash. He doesn't have enough insurance to cover the medical bills, what can he do?

If the drunk driver's insurance isn't enough or he's underinsured and cannot pay the full amount of your dad's medical bills, your dad's own insurance can pay for the remaining sum.

If your dad doesn't have any insurance, he can always file a case for damages against the drunk driver for compensation.

Assuming you mean the at fault driver does not have enough insurance coverage:

Your dad needs to call his insurance company and file a claim under his under-insured motorist coverage.

UIM is not required in every state and not every driver has it.

So your dad should call his agent. If he has UIM coverage, your dads agent can help get the claim filed.

Go ahead and report the claim now. Your dads insurance company will need to do an investigation. This way, your dads company can go ahead and do the investigation so that when the time comes for them to handle the UIM bodily injury claim, they have everything in place.

Situations like this is what UIM coverage is for.

I got hit by a lowlife too. He was insured up to 50 thousand.
I got really messed up and so did my sister. My lawyer got each of us the 50 from the guys insurance co. Now we have to sue our own insurance company. Then our insurance company gets reembursed by the other one. It sucks but we didn't get totally screwed.

The drunk doesn't have enough or your dad? If it's the drunk, then dad should go for his underinsured motorist coverage. If the drunk had no insured, then uninsured motorists coverage.

He can try suing the drunk driver, but usually they don't have any assets.

If there still isn't enough, he should ask the hospital about Hill Burton funds. The federal government gives money to hospitals for building if they treat a certain number of patients for free. They just never tell the patients.

Otherwise, he will have to try to work out something with the medical providers or declare bankruptcy.

And in your spare time, contact your representatives about voting FOR the health care bill so this won't be a problem in the future.
