car accident with no registration or insurance with passenger that got injured?

Hi, my brother and his passenger (girlfriend) had an accident in and unregistered vehicle.
Both know at the time the care was unregistered and with no insurance.
The girlfriend (now ex girlfriend) had injured her foot and somehow got a payout for a sum of money.
The insurance company is now chasing my brother for the money they paid to the passenger.
I would assume that because both people in the car knew the car was not registered or with insurance that my brother and the passenger are both negligent and that the insurance company should stop hounding my brother for the sum of money.
Please can someone advice me as my mum is getting very ill from worry over this matter and my brother has no idea what to do.

reason why insurance cost so much now is people like your brother knew he was wrong but yet wants someone else to pay for his mistake

back when i started driving if you damage anything didnt need insurance to handle it just payed for your mistake but lasy bums and low lifes think life is free and they are owed sometimes for just living if we luckey they wil sue him for every penny he wil make in the next 40 yrs hounding him every day of hes life til he pays what he owes
 
He's screwed! He's going to have to pay up or face a lawsuit. Should have considered the consequences of getting behind the wheel of an unregistered, uninsured car. I feel bad for you and your mom. Hope your brother has learned his lesson. Good luck all.
