In the state of California, if you have a private non tobacco related business that is completely gated, is it legal to make employees go outside the gate off the property to smoke? Or is this considered discrimination? The property is gated and leased (if that makes a difference), once inside the gate it's roughly 50 ft to the actual building doors.
