fully paid judge will throw out plea? I had 2 months to pay almost $700 in fines and I have over half but the court clerk said judge doesn't take payments and will throw my plea out and seek a weekend in jail. I have never been in any trouble in the past and don't know how the system works. Will I be able to request a public defender even though I pleaded guilty. It was to my knowledge that you are able to make payments on a fine anyone I have ever known to have fines they were able to make timely payments. What can I do in this case?
The clerk said the judge won't take payments and I will be given a weekend in jail. I have a clean record and will have $400 towards fine.

Since you have plead already you probably cannot be appointed an attorney, but you might be able to go back to the court and ask for more time to pay the fines.

It is not that he will throw out your plea, if he did you would have the right to an attorney again, but what they do is issue a capias pro fine, or a warrant for failure to pay the fines, and you are brought to jail and set them out. Here they give $50. per day toward financial obligations, but if the defendant states in the beginning that they cannot pay the fines the judge will let them sit in jail at $100.00 per day.

You probably need to talk to some one other than the clerk that you talked to, maybe ask for the collections department next time you call, they should take partial payments. You might have to go back to court and ask the judge to let you make payments.

Good Luck
