Can the D.A. file charges for rape after the statute of limitations is up?

My boyfriend found out a month ago that his ex gf is accusing him of rape. He was contacted by police, they asked him to come in for questioning. He was going to, until we contacted a lawyer and he said absolutely no way should we go in. The statute of limitations is up in may (3 months) it will have been 6 years. Here In oregon thats the limit. He is innocent, and I know if it goes to trial we will win. We have harrassment/stalking evidence on her. We have been waiting for a month now to see if they will press charges, but no news. So my questions: is there a time limit they have to press charges by? And also, can they press charges once may roles around and limitation would be up? I really dont want to spend 10k on a lawyer when I know hes innocent. Please only answer with facts, last time a bunch of people answered without even answering my question, just threw around opinions. Thanks for your time!
