...Please Help!? Okay, I have a F5 (fifth degree felony) case. My father filed the charges against me. I had a lawyer who represented me, we went to court, and decided to enter an Intervention in Lieu of Conviction plea. My next court date is to actually enter this (technically) guilty plea, and to start my one year probationary period. Now, I've learned that over the past two months, he has been speaking with my father. Me and my father are on no speaking terms since I had been arrested. I have e-mails between my lawyer and my father saying things "I can't believe she is messing up," and "No one will get her out when she's in prison." They've been talking about my legal situation between each other, and actually have been talking about my personal life. Now, my lawyer was suppose to file a motion for continuance. I had e-mailed him saying that I felt his conversations with my father was a conflict of interests, so in turn he filed for a motion to withdrawal from representation. Three days before my court date. Now, I live in Florida and I have to go to court in Ohio. I have been led to believe that my court date was pushed because he told me he had filed for a continuance. Now, It's Saturday (my court date is Monday), I cannot figure out if he filed for a continuance, and if he did, if it was even granted (meaning, do I have to go to court Monday or not). Second, I have no representation now, so I'm scared I'll just be sentenced or they won't let me enter my intervention in lieu of conviction plea. Please help!
That's the thing, I don't live in Ohio and the court is closed on the weekend. I've tried calling everyone, I cannot manage to get through to anyone. I'm frustrated and scared. I can find out Monday, but if they tell me that my lawyer didn't file a continuance or it didn't get granted, then It will be too late and I'll have a warrant issued for me, which is a violation of my bond. So, it's the most hectic situation I've ever been in.

My friend is a defense attorney and your lawyer can definitely be disbarred (lose his license to practice law) for what he is doing. In no way shape or form can he talk to ANYONE especially someone on the other side of this case about things pertaining to this case. That information is confidential betwee you and your lawyer. I would present this to the judge and find a new lawyer (make sure you have the items to prove he was discussing details of the case with him).

You need to find yourself a new lawyer. I would also report the last one to the law society (or whatever the equivalent is in the USA) for acting unprofessionally by not keeping a case confidential.

Also, can you possibly go to the court/contact it and ask whether he filed it, or it was granted?
