My mother in law(soon to be ex) is suing me. I am still married to her son legally and should be divorced in September. Her son is a real momma's boy and not very responsible, which is why we are getting divorced. We have 3 kids. He had no goals and only made $9/hr. He barely worked 40 hours a week and wouldnt work any OT. I on the other hand worked my tail off, always working OT and trying to support all of us. I paid $$ for him to work because with his gas and daycare, we didnt make anything off him working. His mom helped us alot, as she always has done with him his while life. Hes spoiled. Anyways, it got to the point where we couldnt make ends meet. He talked to her and she said she'd help out. She is single and makes real good money. No other kids and got big inheritance. She said she would make house payments until we got on our feet and stable. We were drowning in debt and living off credit cards which had become maxed out. We said we'd pay whatever we could each month and she
agreed. Our mortgage is $1500 a month. She paid Jan, Feb and Apr. Out of those months I think we may have given her $2000 or around that and honestly thats all we could afford to give. Bills were coming in left and right. Electricity getting turned off, etc. She still paid May, Jun, July, Aug and Sept without us paying her anything. Her son, my ex, moved out in Sept and that was the end of her paying. Since he wasnt living there she wouldnt help. He left and of course didn't contribute to the house or the kids. Hes a real winner. Anyways, I guess she finally sees that we are not getting back together and 7 months after she stops paying and he moved out, she is suing me for $10k!! Alledging that it was all a loan and only to me!! I NEVER agreed to that and for her to exclude him from the whole thing! WTF! I am trying to support her grandbabies as a single mom and now she wants to sue me!! Do you think she will actually win??
There is nothing in writing and all the payments were made directly to t he company by her. She never wrote a check to me or her son. She doesn't have an attorney, she is filing pro se. And I really can't afford an attorney. I don't have the money for it :(
The deed of the home is in mine and her sons name. The payment is only in my name because his credit was so horrible that we couldn't get approved with his name on the loan. But ultimately since the deed is in his name as well, its legally his home too.
