Can my flashed xbox 360 still get banned from xbox live if I am only

playing an actual xbox game? If i was to play an actual xbox 360 game on xbox live using a flashed xbox 360 could Microsoft still find out that my xbox 360 has been flashed and ban it from live forever? Or is it that just for the people who play a burnt game on live who get caught with a flashed xbox 360
 
The console itself is what is detected not the games so yes, you can get caught and banned from Live even if you only play legal games.
