can jailed husband force wife to move from family home?

Is the house in his name? You need a lawyer to see what your rights are. If you are still married I do not think he can make you move out legally.
 
I'd tell her to take the notice, set it on fire, and pound the ashes straight up his a.ss....he raped her daughter and the bastard is in jail where he belongs. He cannot force her to move out of a home that was owned before the marriage...in fact I wouldn't do a damn thing he told me to.
 
He was convicted of child rape her 14 year daughter his step daughter. He is serving 7 years. They are legally married but the home was bought before the marriage. They have been married for 10 years. She just got a 10 notice served to her on today her Birthday. Any advice?
 
she can stay for much longer, it takes several evictions to actually remove someone. But ultimately, it would be in her best interest to move, for several reasons.
 
If he owns the home yes!! My ex owned the home, attacked me with a baseball bat. The sheriff made me leave within 3 days!!!
