Can I use an att sims card on any att phone?

Im getting a new phone soon but I dont want the data plan. If I get a phone that doesnt require the data plan and then switch the sims card to a smartphone, will it work?
Would they find out if I use the blackberrys features or just by putting the sims card on the phone?
