Can i use a stolen iphone?

Okay, this guy is selling his iphone 3gs 32gb, but he is selling it as an iPod touch. This is because he had the phone stolen, so he told optus and they locked it. He then found it from a guy and called optus but they said that he cannot get the phone unlocked for some reason. He said that you can use the camera, apps, music,videos etc but the calling/sms works intermittently.
I know alot about phones and i was wondering, if i do some jail breaking/hacking could i disable the lock? Is there a way to get around this?
it WAS stole, it would not be tracked down. The owner FOUND it, and isnt stolen anymore. Im only asking because its very cheap.
