Can i take them to a small claims court?

i purchase a phone from att, and returned it 7 days later, they said i should receive a paycheck within 10-20 days its been a month and i have call over 3 times, and every time i keep getting " let me get your number and we'll call you back" i don't want any problems, am not even mad, i just want my money, if i take them to a small claims court will they paid me my money,

call either 1-800-331-0500 or 1-888-333-6651 and ask the first representative you speak with to get their supervisor on the phone. if they give you a hassle, demand the supervisor. good luck, because thats crap.
 
Have you tried to go to an AT&T office to get the refund, as this whole transaction is on their computers and someone may be able to have a check sent to you immediately. It's worth a try. Does AT&T have your correct address to send the check to you. (By the way it isn't a paycheck as you stated, it is a check). Were you to wait, they may or may not send you the check, as they are understaffed and returning money to people is not a priority to them, only profits are a priority and they will want to use your money as long as they can. I wouldn't go to small claims court until three months have passed, as you will be spending time and the cost of the filing in small claims court. Good luck to you.
