Can I take my iPhone 3GS to apple and have them fix it without a warranty..?

I found a iPhone 3GS 16 GB about a year ago and reset it to factory settings. The phone had 2 problems at first. Only 1 headphone worked and the Switch on the side won't work so my phone is never on vibrate. I don't want to go to apple and they say they can fix it with no warranty. HELP PLEASE!!!!???
