Hi I broke my finger and had surgery on it about 2 months ago. I was in a cast for 3 weeks after that. I got a call for a job interview and was told that they would not hire me because I couldn't use my hand. My other hand is fine though and I got the cast removed as planned and wear a brace on it. I want to know if I can sue them for discrimination. There are people out there that don't have hands or legs and they get hired but because I had a cast on they refused to hire me. I am a hard worker and as you may know finding work is hard. All I wanted was an opportunity. The job was at a restaurant making sandwiches. I could have done it with one hand. Do I have a case? My doctor cleared me to work as long as I used my other hand and I let them know that but they still refused. Please help!
Also, my doctor gave me a sterile case to put over the cast when working. It can be washed when you wash your hands so that's not really an issue. State and federal law prohibits employers from discriminating during the hiring process and while a person is working.
I know that there are laws that say you can't discriminate during the hiring process. The lady asked me if I had a disability. She didn't ask me if I could perform the job. Nowhere in the requirements does it say you need both your hands to make sandwiches. I was more than qualified for the job and could perform the job. Also a disability is defined by the government as having a limited ability, unable to perform day to day activities, or known documented disability. I know its just a finger but one finger effects them all. My doctor said that it would be 6 to 8 months before I had function and even then there would be limits and it wouldn't be the same. So therefore I fall under the disability category. If your not sure please don't answer. Also please don't be mean. I'm having a hard enough time trying to get employed with a messed up hand without people being rude. Thank you!
