Can I sell a boost mobile phone that I found on the ground?

I found a motorola i1 android on the ground and want to sell it. If it is reported lost will the phone still be able to be used? If so, what can I do to get it to work?
 
Well... That is both theft, and selling stolen property... That would be jail time, or a hefty fine... You COULD... but it would be very stupid.

Edit: Oh... and the person that buys it is getting charged with buying stolen property... So your not the only one that would be in trouble...
