Can i get out of this ATT Contract under these conditions?

Ok so i originally got a samsung impression, but later got the 2g i phone from a friend, called and upgraded my service to a 2G i phone data plan....then months later, my friend gave me an iphone 3G, and i started using it, i got a text saying att upgraded my data plan and it would be prorated, since i never got a call or agreed to this, is this grounds to leave? cause I'm trying to get out of the contract
