Ok, long story short my boyfriend and I got into an argument in public and he knocked my phone out of my hand...in front of a cop. The officer made a HUGE deal out of it, even called over 6 more officers. My boyfriend never laid a hand on me, raised his voice, cursed, and my phone wasn't damaged. The officer said in our state any threat or act of violence toward someone you have had a sexual relationship with is considered an act of domestic violence. I say it like that because when the officer asked me what was going on, the next question from him was if I had ever had sex with my boyfriend, claiming he needed to clarify the exact meaning of the word boyfriend after I introduced him as well..my boyfriend. Once he was in the car they told me his bond would be 2000, there would be a restraining order issued, and he would be charged with domestic violence, harassment, and assault. I started questioning them but they put him in the back of the car and told him to " tell that stupid ***** to shut before we arrest her too."
I was served and was ordered to talk to a victims advocate. I gave her my story, showed her my phone, and she tried to appeal to the DA about just dropping the charge. He ignored her and had me personally served at my home to appear for the trial. This has gone from bad to outrageous, but I was told that if I just ignore the letters and calls, they wouldn't have much of a case and it would be dropped......although that was before the had me served again. What can I do to get out of making an appearance? The officers didn't listen to me, the victims advocate couldn't help me, and frankly unless I go up and lie and say he was horrible person and a complete danger to cell phones everywhere, the DA won't really care what I have to say.
