...breath or blood test? My roommate and I were walking back to our apartment and there were police men busting a party upstairs. They assumed we were drinking and coming from that party, and wrote us two drinking tickets. We were not around alcohol, were not holding alcohol and did not get asked to breathalize or do a blood test. When we go to court, can we plead not guilty and possibly get out of it because there is no proof that we were drinking?
