Can i get an iphone without the data plan?

hi.. i currently have a phone on my parents AT&T plan with data service with a charge of $10 per month i want to get an iphone (off ebay) and take my sim card from my old phone and put in the iphone.. would this work? and would i be able to keep the $10 per month for the data charge without having to pay $30 a month for the iphone data? and would i be able to just cancel the data plan and not use the data at all except for wifi?
 
the sim card would work but as far as the data part idk bout that i can say to you is try with a friends fone to see if they let you
